1. ACCEPTANCE OF TERMS
Welcome to www.gardenleecorp.com (the “Site”), the official online store of Garden Lee Corporation (“Garden Lee,” “we,” “us,” or “our”). These Terms of Service (“Terms”) constitute a legally binding agreement between you, the user or customer, and Garden Lee Corporation, governing your access to and use of our Site, including all content, functionality, products, and services offered on or through it.
By accessing, browsing, registering an account, or making a purchase on the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Refund and Returns Policy, and Shipping Policy, each of which is incorporated herein by reference. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except for incidental copies made during normal browsing.
The “Garden Lee” name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Garden Lee Corporation or its affiliates or licensors. You must not use such marks without our prior written permission.
5. PRODUCTS, PRICING, AND PURCHASES
5.1 Product Information & Availability: We strive to display product colors, images, specifications, and descriptions as accurately as possible. However, we cannot guarantee that your device’s display of colors will be accurate, or that product descriptions are entirely error-free. All products are subject to availability. We reserve the right to discontinue any product at any time and to limit or cancel quantities purchased per person, per household, or per order.
5.2 Pricing: All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. We reserve the right to correct any pricing errors on the Site, even after an order has been submitted. Applicable taxes and shipping costs will be added to your order total at checkout.
5.3 Order Acceptance: Your placement of an order constitutes an offer to purchase. All orders are subject to acceptance by us. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraud. If we cancel an order, we will attempt to notify you and will issue a refund if payment was collected.
5.4 Payment: You agree to provide current, complete, and accurate purchase and account information. You further agree to promptly update account information, including email address and payment method. You represent and warrant that you have the legal right to use any payment method you provide. We use third-party payment processors. All payment information is transmitted securely, and we do not store your complete payment card details on our servers.

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

- To use any robot, spider, or other automatic device to access the Site for any purpose, including monitoring or copying any material.
- To introduce any viruses or other malicious material.
- To attempt to gain unauthorized access to, or interfere with, the Site, its servers, or connected networks.
- Otherwise attempt to interfere with the proper working of the Site.
7. USER-GENERATED CONTENT
The Site may allow you to post reviews, comments, photos, or other content (“User Content”). You retain ownership of your User Content, but by submitting it, you grant Garden Lee a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content. You represent that you own or control all rights to the User Content you submit and that it is accurate and does not violate these Terms. We have the right, but not the obligation, to monitor and remove any User Content.
8. THIRD-PARTY LINKS
The Site may contain links to third-party websites or services not owned or controlled by Garden Lee. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites. You acknowledge that Garden Lee shall not be responsible for any damage or loss caused in connection with the use of any third-party content or services.
9. DISCLAIMER OF WARRANTIES
THE SITE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SITE ARE PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ FOR YOUR USE, WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GARDEN LEE CORPORATION, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCTS PROCURED VIA THE SITE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNT YOU HAVE PAID TO GARDEN LEE IN THE SIX MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.
11. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Garden Lee Corporation and its affiliates from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms, your use of the Site, or your violation of any law or the rights of a third party.
12. SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
13. GOVERNING LAW & DISPUTE RESOLUTION
These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles.
Any disputes shall be resolved in the courts of the City of Toronto, Ontario, Canada.
14. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund and Returns Policy, and Shipping Policy, constitute the entire agreement between you and Garden Lee Corporation regarding the Site and supersede all prior agreements, communications, and proposals.
